Terms of Service

Please read these Terms of Service ("Terms") carefully before using TalkingCases.ai (the "Service") operated by Cerebo.ai, the parent company that owns TalkingCases.ai. In these Terms, "TalkingCases", "Cerebo.ai", "we", "us", and "our" all refer to the same business.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Who you are paying — please read

TalkingCases.ai is owned and operated by Cerebo.ai, its parent company. All payments — for credits, one-time purchases, and subscriptions — are processed by Cerebo.ai. This means the charge on your credit or debit card statement and on the receipt issued by our payment processor (Stripe) will appear under the name Cerebo.ai (your bank may abbreviate or slightly vary this descriptor). Seeing “Cerebo.ai” on your statement is not an error or fraud — it is your TalkingCases purchase. If you do not recognise a charge, please contact us before disputing it with your bank.

1.2 Account Registration

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of uppercase and lowercase letters, numbers, and symbols) with your account.

2. Medical Disclaimer

2.1 Not Medical Advice

The Service provides educational content related to medical cases and healthcare scenarios. This content is for informational and educational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

2.2 AI-Generated Content

The medical cases, simulations, and interactions in the Service are generated or enhanced using artificial intelligence technologies. While these cases are designed to be realistic and educational, they may contain inaccuracies, inconsistencies, or outdated information.

2.3 Consultation with Healthcare Providers

Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or treatment. Never disregard professional medical advice or delay in seeking it because of something you have learned through our Service.

3. Intellectual Property

3.1 Service Content

The Service and its original content, features, and functionality are owned by TalkingCases and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3.2 User Contributions

By submitting, posting, or displaying content on or through the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute your content in any existing or future media formats.

4. User Conduct

You agree not to use the Service:

  • In any way that violates any applicable local, state, national, or international law or regulation
  • To transmit or procure the sending of any advertising or promotional material, including any "junk mail", "chain letter", or "spam"
  • To impersonate or attempt to impersonate TalkingCases, a TalkingCases employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service

5. Limitation of Liability

5.1 Educational Tool

TalkingCases shall not be liable for any damages that may occur from using the Service. The Service is provided "as is" and "as available" without any warranties, expressed or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5.2 AI-Generated Content Disclaimer

The medical cases and interactions in our Service are generated, enhanced, or reviewed using artificial intelligence. While efforts are made to ensure accuracy, the content may contain errors, inconsistencies, or outdated information. We explicitly disclaim any liability for errors, omissions, or inaccuracies in the AI-generated content.

5.3 Not Medical Advice

TalkingCases is not liable for any decisions made or actions taken based on the information provided through the Service. Users should always consult with qualified healthcare professionals regarding specific medical conditions or treatments.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

8. Payments, Credits & Refunds

Some features require the purchase of credits or a subscription. As noted above, all such payments are processed by Cerebo.ai (the parent company that owns TalkingCases.ai) and will appear on your card statement and Stripe receipt under the name Cerebo.ai. Credits are a consumable digital good: once any credit from a purchase or subscription has been used in a session, that purchase or subscription is non-refundable. Subscriptions renew automatically until you cancel, and charges for an auto-renewed period are non-refundable; cancel via the self-service Billing Portal before the renewal date to stop future charges.

A limited refund may be available for your first purchase within 7 days only if you have used zero credits. Full details, including eligibility and how to request a refund or cancel, are set out in our Refund & Cancellation Policy, which is incorporated into these Terms by reference. We do not guarantee any exam or professional outcome.
